GOVERNANCE QUESTIONS

1.  What control process will come into effect?

2.  Will we have a meeting with Alan Neilsen-Welsh?

3.  Why do we have to remain leaseholders and not have fee simple?

4.  Would we be able to see the terms of new leases before the decision is made?

5.  Is village status better for finances and governance? Why can we not have village status?

6.  Will public works, Park Patrol, fire protection be in operation if the city takes over?

7.  Should we be checking other precedents in Canada?

8.  What do the current legal opinions say about who actually owns Cultus Lake?

9.  Who is responsible for confirming the legal status of who owns Cultus

               Lake?

10. a.] What is the total assessed value of Cultus Lake?

      b.] What is the breakdown between residences, businesses and CLPB properties and their respective       
           improvements [including offices, fire station, equipment, roads, water & sewer systems, docks, etc.]?

11. Would we still be responsible for leases and taxes and where would the taxes go?

12. Will our taxes be the same as the Chilliwack mill rate or will we have a special park rate?

13. If the leaseholders vote to become part of Chilliwack:

      a.] what kind of representation can we expect from Council?

      b.] Park Board or City Council?

      c.] what councilor[s] will be looking out for interests of the residents of Cultus Lake?

14.Who hired the consultants?

15.Can the province provide funding directly to the community for hiring legal help?

16. a.] Who represents the CLCA’s interests in regard to legal and other issues?

                 b.] While Chilliwack will have its own legal counsel, and the provincial government is funding a lawyer to act          
                      on the Soowahlie’s behalf, who has been appointed to protect the legal interests and other issues of the    
                      leaseholders/residents of Cultus Lake?

                 c.] Should the CLCA be hiring legal help?

                 d.] Why was no funding provided for the CLCA or leaseholders/residents for this process?

17. What is their definition of a regional park?

18. What is the make-up of the committee? I am concerned about the jurisdictions represented.

19.What will the outcome be of a "no" vote?

20. Will there be continuing energy for amalgamation after Clint’s retirement?

21. Will the issues from Soowalie be made public?

22. Why do some residents of Cultus Lake feel the province is more interested in the Soowahlie First Nations    
       than the residents of Cultus Lake?

23. Should we hold off until after the 2010 Olympics?

24. Why are we focusing this discussion now when the government seems to be focusing on support for the    
      Olympics?

25. Can the Park Act be revised to give the CLPB more borrowing power?

26.What mechanism will best preserve this jewel…the park?

                    27. Cultus Lake has a need for better governance. The same system that created an unsustainable community such as    
                           Promontory is at odds with the reality of Cultus Lake. If we are to be absorbed into Chilliwack, control processes     
                           much change asit will affect our future.

      Dr. Greg Helseth in his book on Cultus Lake "Cottage Country in Transition" refers to the increased   
      stresses including governance imposed as the lake changes from mixed recreation to primarily residential.     
      Dr.  Deming  of Total Quality Management fame has stated that poor governance is an issue with the system,  
      not the people working within it. This is governance "Best Practice". What control processes are you    
      considering to prevent such unfortunate situations as the one with John Les?

                   28. We cannot defer our taxes, as we presently occupy leased land. If and when we

                         join Chilliwack, can this be changed? It seems discriminatory.

                   29. What will happen to the process if the $65,000 is used prior to completion?

                   30. a.] Why does the Park Board need more money? The infrastructure has been

                              maintained on the status quo.

     b.] Why can we not maintain village status?

                   31. What are the advantages to the residents of Cultus Lake to join Chilliwack?

                   32. Who pays for police protection for Cultus Lake with amalgamation? Will it be

                         improved?

                   33. a.] What is the expectation regarding the amount of the lease payment and to

                              whom would it be paid?

                        b.] Who will set the lease?

                 34. If Cultus Lake amalgamates with Chilliwack:

              a.] how will leaseholder/resident taxes and fees differ from those existing now?
              b.] how would they differ if Cultus Lake became a village?

       35. What is the legal opinion re who "owns Cultus Lake"?

                 36. At this point, we have been told there will be at least 2 public meetings, where

                      consultant reports will be shared; 2 mail-outs; and a web site. Will there be

                      further opportunity to ask questions based on the information we are presented at

                      each session and in the mail-outs?

               37. With some leaseholders living in other communities, will there be adequate

                     advance notice [at least 3 weeks] of the public meetings?

               38. Will the lease be renewable? If not why not?

               39. Are 99 year extendable leases a desirable alternative to freehold?

               40. All of our value lies in two conditions of our present lease:

                   a) renewable lease......it can be 1 or 99 years and it means nothing unless it is automatically renewed.

b) buy out clause....meaning, if the governing body in charge of Cultus Lake Park wants to get rid of us, they must buy us out at fair market value.....It must also be the fair market value that was in effect before they announced they want to get rid of us......

                      Any new deal must include the above of our values will suffer.
                       Questions: a.] Will the new proposed lease include protection of the two conditions
                                       above?

b.] If not, what will the lease include to maintain our values in the
future?

c.] CN Rail was recently given a 99 renewable lease by the BC
Government. Why cannot the same rules apply to leaseholders of
Cultus Lake?

                  41. Proper security is very important at Cultus Lake.

     a.] Would the Park Patrol and COP continue as now?

     b.] How would they be funded – by Chilliwack or by Cultus Lake leaseholders/residents?

     c.] Would there be any authority to remove unruly residents form the Park?

                42. According to information supplied, the committee will include:

                     3 representatives from Park Board, 3 representatives from city and

                     president or alternative from CLCA and 1 representative from Soowahlie.?

                      a. Who decided this?

                      b. Why 3 representatives from Park Board, particularly if it will

                         [presumably] be abolished if Chilliwack takes over? Is this

                         appropriate since the majority of CLPB are voted in by Chilliwack residents?

                      c. Why so little representation from Cultus leaseholders/residents

                        and/or the CLCA?

                      d. How will the respective committee representatives be chosen

43.All 3 representatives from the Park Board for the boundary extension committee could be residents of    
     Chilliwack. If this happens, can the city and/or Park Board appoint extra leaseholder representatives?
